TERMS AND CONDITIONS

By renting equipment or participating in eFoil lessons, you acknowledge and agree to the following terms and conditions regarding your rental, use, or participation:

1. Personal Responsibility and Liability

You assume full responsibility for the proper use of the eFoil during the rental period or lesson. Any damage to the eFoil caused by negligence, misuse, or improper handling will be your responsibility, and you agree to cover all repair or replacement costs. If the eFoil is damaged beyond repair, you will be charged the full replacement value of the equipment.

 

You are also solely responsible for any harm or damage caused to third parties, their property, or the environment while using the eFoil. The owner of the eFoil and/or the instructor will not be held liable for any accidents, injuries, or damages caused to others.

 

2. Assumption of Risk and Disclaimer of Liability

You acknowledge that eFoiling involves inherent risks. By participating in lessons or renting equipment, you assume full responsibility for any personal injuries, accidents, or damages that may occur to you. The owner of the eFoil and/or the instructor will not be held liable for any accidents, injuries, or damages to you or third parties during your use of the eFoil.

 

3. Safety Obligations

You agree to listen to and follow all instructions provided by the instructor or rental provider. This includes wearing a helmet and an impact vest at all times for your own safety. You acknowledge that eFoiling is an extreme sport and is not recommended for individuals who are pregnant, have heart conditions, or are unable to swim.

 

You also agree to maintain a minimum distance of 20 meters from any objects, people, or vessels to avoid accidents. Failure to follow this safety requirement may result in liability for any resulting accidents or damages.

 

4. Alcohol, Drugs, and Medical Conditions

Prior to renting equipment or participating in a lesson, you must ensure that you are not under the influence of alcohol, drugs, or any medical condition that could impair your ability to participate safely. The company reserves the right to refuse service if these conditions are not met or if weather or surf conditions are deemed unsafe.

 

5. Contact Information and Payment

You agree to provide accurate contact details, including your bank account information, for any potential reimbursement or damage claims. If the equipment is returned late, additional charges will apply for the extra rental period. Failure to return hired equipment may result in criminal charges for theft and/or civil liability under the contract.

 

6. Limitation of Liability and Indemnity

Ocean Flyers limits its liability to either re-delivering the services or refunding the costs. This means that if something goes wrong from our side as the company, our obligations are restricted to these two options. Examples of issues that may arise when renting watersport equipment include:

 

    •    Technical failures or defective equipment: If the rented equipment malfunctions.

    •    Booking errors: If there’s a mistake in reserving the equipment, resulting in the renter not having access at the scheduled time.

    •    Cancellations by the company: If Ocean Flyers cancels a booking due to unforeseen circumstances, such as bad weather or unavailability of equipment.

 

In all these cases, we are not liable for indirect damages, such as lost profits or intangible losses. You agree to release Ocean Flyers from any claims arising from the hire and use of the equipment and indemnify them against third-party claims resulting from your use of the equipment.

By participating in a lesson or renting equipment, you confirm that you have read, understood, and agree to these terms and conditions. You acknowledge that you will be held financially responsible for any damage to the eFoil or third-party property during your rental period or lesson.
